Indenture made the Twenty-eighth day of July One thousand nine hundred and twenty six Between John
Peverell Rogers of Penrose in the County of Cornwall Captain Royal Artillery
(retired) (hereinafter called “the Vendor”) of the one part and THOMAS
JAMES HOCKING of Peverell Terrace Porthleven in the said County Coal
Merchant and Emily Jane Hocking his wife (hereinafter called “the Purchasers”) of the other part Whereas the
Vendor is seized of the hereditaments hereinafter assured for an estate in
fee simple in possession free
from incumbrances Now this Indenture Witnesseth that in
consideration of the sum of Two hundred and thirty pounds by the Purchasers to the Vendor paid
on or before the execution of these presents (the receipt whereof he hereby
acknowledges) He the Vendor as Beneficial owner hereby conveys unto the
Purchasers FIRST ALL THAT dwellinghouse shop and premises late in
the occupation of Harriet Kitto and SECONDLY ALL THOSE two
dwellinghouses and prmises now in the occupation of Elizabeth Orchard and
Eva Williams respectively TOGETHER with the two cellars at the rear thereof
ALL which said premises are situate at porthleven in the County of Cornwall
and more particularly delineated in the plan hereon and
thereon coloured marginally red EXEPTING nevertheless
and hereout reserving all mines metals and minerals with power for the vendor
and his lessees tenants and workmen and any other person or persons entitled
so to do to enter upon or under the said premises to search work for and carry
away the same he making reasonable compensation to the Purchaser and their
lessees and tenants for any
building or land part of the said premises that may be damaged or destroyed
thereby to be settled in case of dispute by arbitration TO HOLD the
same with the appurtenances unto the Purchasers in fee
simple as joint Tenants subject to any tenancies therein AND IT IS HEREBY
DECLARED that the
transaction hereby effected does not form part of a larger transaction or of
a series of transactions in respect of which the amount or value or the
aggregate amount or value of the consideration exceeds Five hundred pounds In
Witness whereof the said parties to these presents their hands and seals
the day and year first before written.

MEMO :-
By Conveyance dated 12th May 1930 the
within-named Thomas James Hocking and Emily Jane Hocking conveyed to Cecil
Orchard in fee simple the property secondly described in the within Conveyance
excepting and reserving as is within excepted and reserved.
